These Terms govern access to WorkshopHQ, a software platform used by automotive workshops. By creating an account or using the service, the account holder agrees to these Terms. Please read the Privacy Policy as well.
1. Service and contracting party
WorkshopHQ provides workshop management tools, including customer and vehicle records, bookings, jobs, quotes, invoices, reminders, communications, reports and optional features. The legal entity supplying WorkshopHQ should be identified in your order or invoice. Contact hello@workshophq.co.nz if you need contracting details before purchasing.
2. Eligibility and authority
You must have authority to create an account on behalf of your workshop, provide accurate registration details and ensure your authorised users comply with these Terms. The service is intended for business use.
3. Account security and roles
Keep credentials confidential, use appropriate permissions for staff, notify us promptly of suspicious access and remove access when staff leave. Your business is responsible for activity by its authorised accounts unless the law requires otherwise.
4. Workshop data and customer communications
You control the data your staff upload or enter. You must ensure lawful collection, accuracy, appropriate notices and any consent required for contacting customers by SMS or email. Do not send spam or unlawful messages. Keep vehicle safety, inspection, repair, tax and accounting records as required by applicable law.
5. Subscriptions, free trials and payment
Current prices, included features, trial duration, GST and billing cycle are presented during signup or in Billing and may be subject to a clearly disclosed promotion. Unless a different arrangement is expressly agreed, paid subscriptions renew for each billing period until cancelled. Following trial expiry, a valid payment method and active plan may be required to continue accessing paid features. Failed payments can lead to restricted access after applicable notices.
6. Add-ons, users and usage charges
Optional add-ons, additional users, SMS usage and other metered services may incur separate charges. Charges and included allowances depend on the current plan and displayed pricing. SMS delivery can depend on telecom providers and recipient details; usage fees and delivery outcomes should be reviewed in the relevant billing terms before enabling paid messaging.
7. Cancellation and refunds
You may request cancellation through the account billing controls or support. Cancellation timing, future access, and any refund entitlement depend on the plan, billing arrangement and applicable New Zealand law. We do not exclude rights or remedies that cannot lawfully be excluded. Charges already incurred may remain payable.
8. Availability and external services
We work to provide reliable services but cannot promise uninterrupted operation. Hosting, authentication, payment processors, telecom networks and external integrations may affect availability. Maintain appropriate operational backups and contingency processes for critical workshop activities.
9. Acceptable use and intellectual property
Do not gain unauthorised access, interfere with other accounts, upload malicious code, reverse engineer contrary to applicable law, or misuse communications. WorkshopHQ retains rights in its software and branding. You retain ownership of information you lawfully provide, subject to the permissions necessary for us to provide the service.
10. Data access, export and termination
When an account ends, access may be limited or disabled. Subject to applicable law and available product features, contact support about exporting business records. We may retain billing, security or other records where required by law or legitimate obligations. We may suspend an account for serious security threats, unlawful conduct or non-payment in accordance with the agreement and applicable law.
11. Liability and New Zealand law
Nothing in these Terms limits liability or consumer or statutory rights where the law prohibits that limitation. To the extent permitted by law, each party is responsible for losses attributable to its own obligations and we exclude indirect or consequential business losses. These Terms are governed by New Zealand law, subject to mandatory laws that apply.
12. Changes and contact
